Chapter 4: Shuroot Scenario Question 01

Can a marriage contract restrict where the couple lives?

Scenario: The bride includes a condition in the Aqd stating the couple must reside in Auckland to stay near her family. Two years later, the husband gets a job offer in another city and insists they move. Is he legally bound by the condition?

Fiqh Reality & Answer: Yes, he is bound. Custom conditions (Shuroot) agreed upon prior to the Aqd are legally binding. He cannot force a move unless she voluntarily agrees to waive her condition.
Chapter 3: Nafaqah Scenario Question 02

Is the husband required to pay housing if the wife works?

Scenario: A wife earns a higher salary than her husband. The husband stops paying household bills, claiming she should contribute equally to living costs. Is he in violation of Ja'fari Fiqh?

Fiqh Reality & Answer: Yes, he is in violation. Maintenance (Nafaqah) is an absolute financial obligation and legal debt (Dayn) on the husband. The wife retains 100% autonomy over her income.
Chapter 4: Risk Mitigation Scenario Question 03

How does Wikalat an-Talaq protect the wife against abandonment?

Scenario: A bride requests a delegated right of divorce (Wikalat an-Talaq) triggered if the husband abandons support for over 6 months. Does this give her "blanket power" to divorce at any time?

Fiqh Reality & Answer: No. It is a conditional trigger that acts as his legal proxy. She can only execute the proxy if the specific objective condition (6 months of abandonment) is met.

Why does asking for a "chore list" fail in household management?

Scenario: A husband tells his studying wife to write a daily list of tasks for him to do. Why does she still feel exhausted and overwhelmed despite his physical help?

Fiqh Reality & Answer: Because she is still burdened with the full "Mental Load" (planning and managing). Islamic ethics (Mu'asharah bil-Ma'ruf) encourages collaborative domain ownership rather than passive delegation.
